Retaliation and Civil Rights Actions (42 Usc 1983) Against Officers on Duty. It is common for citizens to claim they were detained or arrested, not because of a criminal act or traffic violation, but for what they were saying or doing at the time of their seizure. Their lawsuits claim they were retaliated against for exercising their rights under the First Amendment to the Constitution.
